Welcome to Twenfive Media. These Terms & Conditions govern the use of our website and the services provided by Twenfive Media. By accessing our website or engaging our services, you agree to these Terms & Conditions.
Twenfive Media provides creative and media services, including commercial photography, video production, advertising films, content creation, social media content, brand strategy, creative direction, post-production, AI-assisted production, e-commerce content, and related creative services.
The exact scope of each project will be agreed upon between Twenfive Media and the client before work begins. Services, deliverables, timelines, revisions, locations, models, equipment, production requirements, and other project details may vary depending on the agreed quotation or proposal.
Any work or service not specifically included in the approved quotation may be charged separately.
All quotations are based on the project requirements discussed at the time of preparation.
Quotations are valid for the period specified in the quotation. If no validity period is mentioned, Twenfive Media reserves the right to revise the quotation after 15 days.
Additional requirements, changes in scope, extra production days, additional locations, models, props, equipment, travel, special effects, editing, revisions, or other expenses may result in additional charges.
All applicable taxes, government charges, platform fees, or third-party costs will be charged where applicable.
A project is considered confirmed only after the required advance payment has been received and the project has been formally confirmed by Twenfive Media.
Unless otherwise agreed in writing, an advance payment of 50% may be required before production or project commencement.
The remaining balance must be paid according to the payment schedule stated in the approved quotation or invoice.
Twenfive Media reserves the right to pause or withhold delivery of final materials if outstanding payments remain unpaid.
Once a project has been confirmed and production resources have been booked, cancellation or significant rescheduling may result in charges.
Any advance payment may be non-refundable where Twenfive Media has already committed resources, booked locations, models, crew, equipment, suppliers, or other production services.
If a client requests a change of date, Twenfive Media will make reasonable efforts to accommodate the request, subject to team and production availability.
Third-party cancellation or rescheduling charges may also be payable by the client.
The client is responsible for providing accurate information, products, brand assets, approvals, references, access, and other materials required to complete the project.
The client must ensure that all products, trademarks, logos, images, information, claims, and other materials supplied to Twenfive Media can legally be used for the intended project.
Delays caused by the client, including delayed approvals, unavailable products, missing information, or late feedback, may affect the agreed delivery schedule.
Twenfive Media may provide creative concepts, moodboards, scripts, storyboards, references, art direction, styling suggestions, and other creative recommendations.
Creative outcomes may vary depending on the actual production environment, available products, locations, models, lighting, styling, weather, technical conditions, and other circumstances.
Twenfive Media will make reasonable efforts to deliver work in accordance with the approved creative direction.
The number of revisions included in a project will be specified in the quotation or proposal.
Additional revisions, changes to an approved concept, reshoots, new scripts, new creative directions, or changes requested after approval may be charged separately.
Once a final deliverable has been approved, further changes may be treated as a new service.
Photography and video deliverables will be provided according to the specifications agreed upon in the quotation.
Raw files, unedited footage, project files, source files, or working files are not automatically included unless specifically stated in writing.
Twenfive Media determines the technical specifications, file formats, compression, editing approach, colour treatment, and delivery method unless otherwise agreed.
Where models, studios, locations, makeup artists, stylists, production crew, equipment suppliers, voice artists, influencers, or other third-party services are required, their fees may be included in the quotation or charged separately.
Availability of third-party resources is subject to confirmation.
Twenfive Media is not responsible for third-party delays, cancellations, restrictions, or changes outside its reasonable control.
Estimated delivery timelines will be communicated based on the agreed project scope.
Delivery timelines may change due to client delays, additional revisions, production changes, technical issues, third-party delays, public holidays, force majeure events, or other circumstances outside Twenfive Media’s reasonable control.
Urgent or expedited delivery may be available subject to additional charges and team availability.
Unless otherwise agreed in writing, Twenfive Media retains ownership of its original creative concepts, production methods, working files, project files, templates, processes, and other underlying creative materials.
Upon full payment, the client receives the agreed rights to use the final approved deliverables for the purposes specified in the quotation or agreement.
Any broader usage, resale, licensing, transfer, or commercial exploitation beyond the agreed scope may require additional permission or licensing fees.
Unless the client specifically requests otherwise in writing before publication, Twenfive Media may use completed work created for the client for its portfolio, website, social media, advertising, presentations, awards, case studies, and other promotional purposes.
Where confidentiality or launch restrictions apply, the client should communicate these requirements to Twenfive Media before the project begins.
Twenfive Media may use artificial intelligence and AI-assisted creative technologies where appropriate for concept development, image generation, video production, post-production, enhancement, editing, compositing, or other creative applications.
AI-generated or AI-assisted outputs may be subject to technical limitations and may require human creative direction, editing, and quality control.
Where AI-generated elements are used, the final deliverable will be reviewed and developed by Twenfive Media according to the agreed creative requirements.
For social media, content creation, digital marketing, advertising, strategy, and related services, results may depend on factors outside Twenfive Media’s direct control, including platform algorithms, advertising platforms, market conditions, audience behaviour, competition, budgets, and third-party platform policies.
Twenfive Media does not guarantee specific sales, leads, followers, engagement, reach, revenue, or other business results unless a specific guarantee has been expressly agreed upon in writing.
Where Twenfive Media manages advertising campaigns, the client is responsible for providing accurate business information, required access, approved budgets, payment methods, and legally compliant advertising materials.
Advertising spend paid to platforms such as Meta, Google, TikTok, or other third parties is separate from Twenfive Media’s service fees unless specifically stated otherwise.
Twenfive Media is not responsible for advertising account suspension, rejection, restrictions, algorithm changes, policy changes, or decisions made by third-party platforms.
Twenfive Media will make reasonable efforts to keep confidential information provided by the client private and will not intentionally disclose such information to unauthorised third parties, except where disclosure is required to provide the agreed services, comply with applicable law, or protect Twenfive Media’s legal rights.
If the project requires stock images, music, fonts, software, plugins, locations, talent, licences, or other third-party materials, additional licensing or usage restrictions may apply.
The client is responsible for any third-party materials supplied directly by the client and must ensure that appropriate rights and permissions have been obtained.
The client is responsible for reviewing and approving creative concepts, scripts, designs, photographs, videos, captions, advertisements, and other deliverables.
Once a deliverable has been approved by the client, Twenfive Media will not be responsible for errors or changes that could reasonably have been identified during the approval process.

To the maximum extent permitted by applicable law, Twenfive Media will not be liable for indirect, incidental, consequential, or business losses arising from the use of its services or deliverables.
Twenfive Media’s total liability in relation to a project will, where legally permitted, be limited to the amount paid by the client for the specific service giving rise to the claim.
Twenfive Media will not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, government restrictions, emergencies, technical failures, power outages, severe weather, illness, accidents, strikes, internet or platform failures, or other unforeseen events.
Where reasonably possible, Twenfive Media will work with the client to reschedule or find an alternative solution.
